Article 308 – Interpretation

References in this Part to a State shall include references to a Union territory or a special area in respect of which special provisions may have been made under this Constitution.

Article 309 – Recruitment and conditions of service of persons serving the Union or a State

Parliament may by law regulate the recruitment and conditions of service of persons appointed to public services and posts in connection with the affairs of the Union; and the Legislature of a State may by law regulate the recruitment and conditions of service of persons appointed to public services and posts in connection with the affairs of the State.

Article 310 – Tenure of office of persons serving the Union or a State

Persons serving the Union or a State hold office during the pleasure of the President or Governor, as the case may be, subject to the provisions of this Constitution.

Article 311 – Dismissal, removal or reduction in rank of persons employed in civil capacities under the Union or a State

(1) No person who is a member of a civil service of the Union or of an All-India Service or holds a civil post under the Union shall be dismissed or removed by an authority subordinate to that by which he was appointed.

(2) No person who is a member of a civil service of the Union or of an All-India Service or holds a civil post under the Union shall be dismissed or removed or reduced in rank except after an inquiry in which he has been informed of the charges against him and given a reasonable opportunity of being heard.

(3) Clause (2) shall not apply to a dismissal or removal or reduction of a person appointed by the President to any civil service or post under the Union except after an inquiry conducted in such manner as the President may by rule prescribe.

Article 312 – All-India Services

(1) If the Council of States declares by resolution that it is necessary or expedient in the national interest to create an All-India Service common to the Union and the States, Parliament may by law create such a service.

(2) Parliament may regulate the recruitment and conditions of service of persons appointed to any such service.

Article 313 – Continuance in service of persons serving certain Corporations

Article 314 – Control by Union over certain services

Parliament may by law provide for the control of the Union over recruitment and conditions of service of persons serving in services under the Union or a State where Parliament so declares.

Article 315 – Public Service Commissions for the Union and the States

There shall be a Public Service Commission for the Union and a Public Service Commission for each State; and a joint Public Service Commission for two or more States may be appointed if Parliament so provides.

Article 316 – Appointment and term of office of members

The Chairman and other members of a Public Service Commission shall be appointed by the President; they shall hold office for a term of six years or until they attain the age of sixty-five years, whichever is earlier.

Article 317 – Removal and suspension of a member of a Public Service Commission

(1) The President may remove a member of a Commission except in cases provided by this Constitution.

(2) A member may be suspended by the President in the manner and for reasons prescribed by law.

Article 318 – Power to determine conditions of service of members and staff of Public Service Commissions

Parliament or the State Legislature may by law determine the conditions of service of the members and staff of a Public Service Commission.

Article 319 – Prohibition as to re-employment

No person who has held office as Chairman or member of a Public Service Commission shall be eligible for further office under the Government of India or of a State, as prescribed by law.

Article 320 – Functions of Public Service Commissions

The Public Service Commissions shall conduct examinations for recruitment, advise on matters relating to recruitment, promotions, and disciplinary matters.

Article 321 – Power of Parliament to extend functions of Public Service Commissions

Parliament may by law extend the functions of a Public Service Commission to any other purpose.

Article 322 – Expenses of Public Service Commissions

The expenses of the Union and State Public Service Commissions shall be charged on the Consolidated Fund of India or of the State, as the case may be.

Article 323 – Reports of Public Service Commissions

Each Public Service Commission shall present an annual report on its work to the President or the Governor, who shall cause it to be laid before Parliament or the State Legislature.
